On July 15, 2014, the Court ordered: "Defendant Nationstar Mortgage, LLC (“Nationstar”), and those persons in active concert or participation with Nationstar who receive actual notice of this Order by personal service or otherwise, are hereby restrained and enjoined by this Order from pursuing a lock-out of Plaintiff or otherwise taking possession of or entering the property."
"Because all assignments must be recorded before a party may commence a foreclosure by advertisement proceeding, and because there is record evidence of an unrecorded assignment of the mortgage, the Court finds that Wells Fargo failed to strictly comply with Minn. Stat. § 580.02. As a consequence, [the Homeowner] is likely to succeed on the merits of his claim that the foreclosure sale in this case is void."
